1. Agreement to Terms

By accessing or using FeedPane ("Service"), operated at feedpane.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By signing up for a FeedPane account or embedding a FeedPane widget on your website, you represent that you are at least 18 years old and have the legal authority to enter into this agreement.

2. Description of Service

FeedPane provides a software-as-a-service (SaaS) platform that allows users to embed their Instagram account's feed on external websites. The Service includes:

• An authenticated connection to the user's Instagram account via Meta's official APIs
• An embeddable JavaScript widget for displaying Instagram posts on websites
• A user dashboard for managing widget settings, customisation, and billing
• Automatic synchronisation of Instagram content at defined intervals

3. Accounts and Registration

To use the full Service, you must create an account by providing a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to notify us immediately at support@feedpane.com if you suspect any unauthorised use of your account. We are not liable for any loss or damage arising from your failure to safeguard your account.

You may not create accounts using automated means or misrepresent your identity or affiliation.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Use the Service in any way that violates applicable law or regulation
• Use the Service to display content that is illegal, harmful, defamatory, obscene, or infringing on third-party rights
• Attempt to gain unauthorised access to any part of the Service or its related systems
• Reverse engineer, decompile, or disassemble the widget or any part of the Service
• Use the Service to scrape or harvest data from Instagram or any third-party platform
• Resell, sublicense, or redistribute the Service without written permission
• Use the Service in a manner that could disable, overburden, or impair its infrastructure

5. Instagram and Meta Compliance

Our Service connects to Instagram via Meta's official Graph API and Display API. By using our Service, you agree to comply with Meta's Terms of Service, Instagram's Platform Policy, and all applicable Meta developer policies.

You represent that you have the legal right to display the Instagram content you choose to embed. You are solely responsible for ensuring that the content displayed through your widget does not infringe any third-party rights.

We may be required to suspend or terminate access to the Service if Meta revokes our API access or modifies its policies. We will make reasonable efforts to notify you of such changes.

6. Subscriptions and Billing

FeedPane offers both a free tier and paid subscription plans (Pro, Business, Agency). Paid plans are billed monthly or annually via Stripe. All prices are listed in USD.

• Free Plan: Available indefinitely at no charge, subject to feature limitations described on the pricing page.
• Paid Plans: Billed at the start of each billing cycle. Subscriptions automatically renew unless cancelled.
• Cancellation: You may cancel your subscription at any time through the billing portal in your dashboard. Your paid features will remain active until the end of the current billing period, after which your account will revert to the Free plan.
• Refunds: We offer a 14-day money-back guarantee on all new paid subscriptions. Refund requests after 14 days are at our discretion.
• Price Changes: We may change subscription prices with at least 30 days' notice. Continued use after notice constitutes acceptance of the new price.

7. Intellectual Property

The Service, including its design, software, code, branding, and content (excluding user-generated content), is the intellectual property of FeedPane and its licensors. You may not copy, modify, distribute, or create derivative works without our express written permission.

By connecting your Instagram account, you grant FeedPane a limited, non-exclusive, royalty-free licence to fetch and display your Instagram content solely for the purpose of delivering the Service to you.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. FEEDPANE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

We make no guarantee regarding the availability, accuracy, or timeliness of Instagram content fetched through the Service. Instagram API availability is outside of our control.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FEEDPANE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total aggregate liability to you for any claims arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim, or $50, whichever is greater.

10. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms, engage in fraudulent activity, or if required by law. You may terminate your account at any time by contacting us or cancelling through your dashboard.

Upon termination, your access to the Service will cease and your data may be deleted in accordance with our data retention policies described in the Privacy Policy.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice in the dashboard. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
